RE: The tariff classification of aluminum foil and plastic wrap from China

Dear Ms. McClain:

In your letter dated February 6, 2013 you requested a tariff classification ruling. You submitted descriptive literature and samples. The samples are being returned with this ruling.

The first product to be imported is aluminum foil. The foil has a thickness of 0.012mm. It will be imported in 25 foot rolls. The second product under consideration is plastic wrap composed of polyethylene. The wrap will be imported in 50 foot rolls. Both the rolls of plastic wrap and aluminum will be used in a Wraptasticâ„¢ Dispenser after importation. The dispenser is not included.

The applicable subheading for aluminum foil will be 7607.11.6000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for aluminum foil (whether or not printed, or backed with paper, paperboard, plastics or similar backing materials) of a thickness (excluding any backing) not exceeding 0.2 mm, not backed, rolled but not further worked, of a thickness not exceeding 0.15 mm, of a thickness exceeding 0.01 mm. The general rate of duty will be 5.3 percent ad valorem.

The applicable subheading for the plastic wrap will be 3920.10.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other plates, sheets, film, foil and strip, of plastics, noncellular and not reinforced, laminated, supported or similarly combined with other materials: of polymers of ethylene. The rate of duty will be 4.2 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
